Tech giants likeMicrosoft, OpenAI,and now Nvidia are facing lawsuits for various reasons, such asunapproved data harvestingand copyright infringement. Furthermore, three authors accuse the company of using their data to train large language models (LLMs) in the Megatron library.

However, there is a high possibility that the library used for the NeMo generative AI framework has unlicensed copyrighted works. On top of that, the lawsuit encompasses only the models of NeMo Megatron released in September 2022.

Nvidia is facing an AI lawsuit for knowingly using copyrighted books belonging to Brian Keene, Abdi Nazemian, and Stewart O’Nan. Additionally, the authors believe that the company indirectly admitted to their claims by taking down the AI models. However, Nvidia used a training dataset that was no longer available due to copyright infringement, containing 196,640 books.

Another issue from the lawsuit is that Nvidia made copies of the plaintiffs’ works for AI training. Furthermore, according toThe Register, the company distributed NeMO Megatron models under an open license on Hugging Face. On top of that, Nvidia advertised the models as a base for the further ones. Thus, the company engaged in multiple copyright violations.

The novelists hope that the Nvidia lawsuit will urge the company to delete the copies of their work. In addition, they want remunerations for the damages. Moreover, according to thecase document, the plaintiffs demand judgment in their favor. On top of that, they want a pre and post-judgment interest at the highest legal rate.

Ultimately, the Nvidia lawsuit might change how the company gathers and uses its data. Furthermore, they will need to delete their datasets containing copyrighted licenses. However, Nvidia considers that the NeMo Megatron AI model does not infringe copyright laws. Moreover, a spokesperson claimed that the company respects the rights of content creators.
